Ministerial Direction 117: New Family Visa Processing Priorities


On 25 July 2026, the Australian Government introduced Ministerial Direction No. 117, which establishes a new order for processing Family visa applications. It replaced Ministerial Direction No. 102.


The most significant change is that greater priority is now given to certain Family visa applications lodged by applicants who were in Australia at the time of application.


What is Ministerial Direction 117?


Ministerial Direction 117 is a legally binding direction issued under the Migration Act 1958. It instructs Department of Home Affairs decision-makers about the order in which Family visa applications should be considered and decided.

The Direction does not change the legal criteria for the grant of a Family visa. Applicants must still satisfy all relevant visa requirements, including health, character, sponsorship and relationship requirements.


It also does not guarantee that an application will be decided within a particular timeframe. Its purpose is to determine which categories of applications receive priority when the Department allocates its processing resources.


The most significant change


Under Direction 117, the highest general priority is given to Family visa applications where:

  • the primary applicant was in Australia when the application was lodged; and
  • the visa can be granted while the applicant remains in Australia.

Lower priority is given to applications where:

  • the primary applicant was outside Australia when the application was lodged; or
  • the visa requires the applicant to be outside Australia at the time of grant.

This creates an important distinction between eligible onshore Family visa applications and offshore Family visa applications.


For example, an eligible onshore Partner visa application may now be processed ahead of an offshore Partner or Prospective Marriage visa application, even if the offshore application was lodged earlier.

However, this does not mean that every onshore application will be finalised before every offshore application. Processing will continue to depend on the circumstances, complexity and readiness of each application.


Order of processing


Within the onshore and offshore categories, Family visa applications are generally prioritised in the following order:


  1. Family migration applications that have been subject to ministerial intervention.
  2. Applications made by a partner or dependent child.
  3. Applications made by an orphan relative.
  4. Applications made by a contributory parent or contributory aged parent.
  5. Applications made by a carer.
  6. Applications made by a parent, aged parent, remaining relative or aged dependent relative.


The applicant’s location and whether the visa can be granted onshore are considered first. The above order is then applied within those broader categories.


What does this mean for Partner and Prospective Marriage visas?


Direction 117 may have a significant effect on applicants waiting for Partner or Prospective Marriage visas.

Eligible onshore Partner visa applications are now placed in a higher processing category than applications where the primary applicant applied outside Australia or must be outside Australia at the time of grant.


This may affect applicants for visas including:


  • Partner visa subclasses 820 and 801;
  • Partner visa subclasses 309 and 100; and
  • Prospective Marriage visa subclass 300.


Applicants waiting outside Australia may experience longer processing periods if the Department directs more resources towards higher-priority onshore applications.


However, the Direction does not suspend offshore processing. Offshore Partner, Child and Prospective Marriage applications will continue to be processed and decided. They have simply been placed in a lower processing category when compared with eligible onshore applications.


What happens to applications that were lodged before 25 July 2026?


People who lodged their applications before the commencement of Direction 117 generally do not need to lodge a new application.


Applications that remain undecided will be dealt with under the processing priorities applying to Departmental decision-makers. This means that an existing application may now be given a higher or lower relative priority depending on:


  • where the primary applicant was located when the application was lodged;
  • whether the visa can be granted while the applicant is in Australia; and
  • the type of Family visa applied for.


The Direction does not cancel, invalidate or refuse an existing application. It changes its relative position for processing purposes.


It also does not mean that applications will necessarily be processed strictly according to their lodgement dates. A more recently lodged application in a higher-priority category may be considered before an older application in a lower-priority category.


Applicants should not withdraw and relodge an application simply because of the new Direction. Doing so may result in the loss of the original lodgement date, additional visa application charges and other legal consequences.


What if an application is already under assessment?


If the Department has already started assessing an application, Direction 117 does not guarantee that the application will immediately be decided or that its assessment will stop.


The time required to finalise an application may continue to depend on matters such as:

  • health and character checks;
  • security assessments;
  • requests for further information;
  • verification of documents;
  • whether all required evidence has been provided;
  • the complexity of the applicant’s circumstances; and
  • the availability of places within the Migration Program.


The status “further assessment” does not necessarily mean that a decision is imminent. It generally means that the application remains under consideration and that further checks or assessment may be required.


Compassionate and compelling circumstances


Direction 117 allows the Department to depart from the ordinary priority order in limited cases.

An application may be considered for priority processing where:

  • there are special circumstances of a compassionate nature; and
  • there are compelling reasons to depart from the usual order of priority.


Each request is considered individually. Merely experiencing a long separation, financial pressure or ordinary emotional hardship associated with waiting will not automatically result in priority processing.


A priority request should be supported by clear and current evidence demonstrating why the circumstances are exceptional and why an earlier decision is necessary.

في 25 يوليو/تموز 2026، أصدرت الحكومة الأسترالية التوجيه الوزاري رقم 117، الذي وضع ترتيباً جديداً لمعالجة طلبات تأشيرات العائلة، وحلّ محل التوجيه الوزاري رقم 102.


أهم تغيير جاء به هذا التوجيه هو إعطاء أولوية أعلى لبعض طلبات تأشيرات العائلة التي تم تقديمها 

من داخل أستراليا.


ما هو التوجيه الوزاري رقم 117؟


التوجيه الوزاري رقم 117 هو توجيه ملزم قانوناً صدر بموجب قانون الهجرة الأسترالي لسنة 1958. وهو يحدد الترتيب الذي يجب على موظفي دائرة الهجرة اتباعه عند دراسة طلبات تأشيرات العائلة واتخاذ القرارات بشأنها.


هذا التوجيه لا يغيّر الشروط القانونية المطلوبة للحصول على تأشيرة عائلية. فلا يزال يتعين على المتقدم استيفاء جميع الشروط المتعلقة بالتأشيرة، بما فيها متطلبات الصحة والسجل الجنائي والكفالة وإثبات العلاقة.


كما أن التوجيه لا يضمن صدور القرار خلال مدة زمنية محددة، وإنما يحدد الطلبات التي تُعطى الأولوية عند توزيع دائرة الهجرة لمواردها وموظفيها.


ما هو أهم تغيير؟

بموجب التوجيه رقم 117، تُعطى أعلى أولوية عامة لطلبات تأشيرات العائلة التي:

  • كان مقدم الطلب الرئيسي موجوداً داخل أستراليا عند تقديم الطلب؛ و
  • يمكن منح التأشيرة لمقدم الطلب أثناء وجوده داخل أستراليا.

أما الأولوية الأقل فتُعطى للطلبات التي:

  • كان مقدم الطلب الرئيسي خارج أستراليا عند تقديم الطلب؛ أو
  • تشترط أن يكون مقدم الطلب خارج أستراليا وقت منح التأشيرة.


هذا يعني وجود فرق واضح في أولوية المعالجة بين بعض طلبات تأشيرات العائلة المقدمة من داخل أستراليا والطلبات المقدمة من خارجها.


على سبيل المثال، قد تتم معالجة طلب تأشيرة شريك مؤهل ومقدم من داخل أستراليا قبل طلب تأشيرة شريك أو خطوبة مقدم من خارج أستراليا، حتى لو كان الطلب الخارجي قد قُدّم في تاريخ أسبق.

لكن هذا لا يعني أن كل طلب مقدم من داخل أستراليا سيصدر فيه قرار قبل جميع الطلبات الخارجية. ستظل مدة المعالجة تعتمد على ظروف كل طلب ومدى تعقيده واكتمال المستندات والفحوصات المطلوبة.


ترتيب معالجة طلبات تأشيرات العائلة

ضمن فئتي الطلبات الداخلية والخارجية، يكون ترتيب معالجة طلبات تأشيرات العائلة بشكل عام كما يلي:


  1. طلبات الهجرة العائلية التي خضعت للتدخل الوزاري.
  2. طلبات الشريك أو الطفل المُعال.
  3. طلبات الأقارب الأيتام.
  4. طلبات الوالدين بمساهمة مالية أو الوالدين المسنين بمساهمة مالية.
  5. طلبات تأشيرة مقدم الرعاية.
  6. طلبات الوالدين أو الوالدين المسنين أو الأقارب المتبقين أو الأقارب المسنين المُعالين.


يتم أولاً النظر إلى مكان وجود مقدم الطلب الرئيسي وقت تقديم الطلب، وما إذا كان يمكن منح التأشيرة له داخل أستراليا. بعد ذلك، يُطبق ترتيب أنواع التأشيرات المذكور أعلاه داخل كل فئة.


ماذا يعني ذلك لتأشيرات الشريك والخطوبة؟


قد يكون للتوجيه رقم 117 تأثير مهم على الأشخاص الذين ينتظرون صدور قرارات بشأن تأشيرات الشريك أو الخطوبة.


أصبحت طلبات تأشيرات الشريك المؤهلة والمقدمة من داخل أستراليا ضمن فئة معالجة أعلى من الطلبات التي قُدمت عندما كان مقدم الطلب الرئيسي خارج أستراليا، أو التي تشترط وجوده خارج أستراليا وقت منح التأشيرة.


وقد يؤثر ذلك في المتقدمين لتأشيرات تشمل:

  • تأشيرة الشريك من داخل أستراليا، الفئتين 820 و801؛
  • تأشيرة الشريك من خارج أستراليا، الفئتين 309 و100؛
  • تأشيرة الزواج المرتقب أو الخطوبة، الفئة 300.


قد يواجه بعض المتقدمين الموجودين خارج أستراليا فترات انتظار أطول إذا خصصت دائرة الهجرة المزيد من مواردها لمعالجة الطلبات الداخلية ذات الأولوية الأعلى.


لكن التوجيه لا يعني إيقاف معالجة الطلبات الخارجية. ستستمر دائرة الهجرة في دراسة طلبات الشريك والأطفال والخطوبة المقدمة من خارج أستراليا واتخاذ القرارات بشأنها، إلا أن هذه الطلبات أصبحت ضمن فئة أولوية أقل مقارنة بالطلبات الداخلية المؤهلة.


ماذا يحدث للطلبات المقدمة قبل 25 يوليو/تموز 2026؟

الأشخاص الذين قدموا طلباتهم قبل بدء العمل بالتوجيه رقم 117 لا يحتاجون، بشكل عام، إلى تقديم طلب جديد.


الطلبات التي لم يصدر فيها قرار نهائي ستخضع لأولويات المعالجة التي يتعين على موظفي دائرة الهجرة اتباعها. لذلك قد يحصل الطلب الحالي على أولوية أعلى أو أقل بحسب:

  • مكان وجود مقدم الطلب الرئيسي وقت تقديم الطلب؛
  • ما إذا كان يمكن منح التأشيرة أثناء وجوده داخل أستراليا؛
  • نوع تأشيرة العائلة المطلوبة.


التوجيه لا يلغي الطلبات السابقة ولا يجعلها غير صالحة ولا يؤدي بحد ذاته إلى رفضها، وإنما يغيّر ترتيبها النسبي لأغراض المعالجة.

كما أنه لا يعني أن جميع الطلبات ستُعالج حصراً حسب تاريخ تقديمها. فقد تتم دراسة طلب أحدث يقع ضمن فئة ذات أولوية أعلى قبل طلب أقدم يقع ضمن فئة ذات أولوية أقل.

لا ينبغي سحب الطلب وإعادة تقديمه لمجرد صدور التوجيه الجديد. فقد يؤدي ذلك إلى فقدان تاريخ التقديم الأصلي، ودفع رسوم إضافية، وحدوث عواقب قانونية أو متعلقة بوضع مقدم الطلب في أستراليا.


ماذا لو بدأت دائرة الهجرة بالفعل في دراسة الطلب؟

إذا بدأت دائرة الهجرة في تقييم الطلب، فإن التوجيه رقم 117 لا يضمن صدور القرار فوراً، كما لا يعني بالضرورة أن دراسة الطلب ستتوقف.


قد تعتمد المدة اللازمة لإنهاء الطلب على عدة أمور، منها:

  • الفحوصات الصحية وفحوصات السجل الجنائي؛
  • التدقيقات الأمنية؛
  • طلب معلومات أو مستندات إضافية؛
  • التحقق من صحة الوثائق؛
  • مدى اكتمال الأدلة المطلوبة؛
  • تعقيد ظروف مقدم الطلب؛
  • عدد الأماكن المتاحة ضمن برنامج الهجرة.


ظهور حالة الطلب على أنه قيد التقييم الإضافي – Further Assessment لا يعني بالضرورة أن القرار سيصدر قريباً. ويعني بشكل عام أن الطلب لا يزال قيد الدراسة، وقد تكون هناك فحوصات أو إجراءات إضافية لم تكتمل بعد.


الظروف الإنسانية والاستثنائية


يسمح التوجيه رقم 117 لدائرة الهجرة بالخروج عن ترتيب الأولويات المعتاد في حالات محدودة.

قد يُنظر في إعطاء الطلب أولوية إذا:

  • كانت هناك ظروف خاصة ذات طبيعة إنسانية؛ و
  • وُجدت أسباب مقنعة تستدعي الخروج عن ترتيب الأولوية المعتاد.


تتم دراسة كل حالة بصورة منفصلة. طول مدة الانفصال أو الضغوط المالية أو الصعوبات العاطفية المعتادة الناتجة عن الانتظار لا تؤدي تلقائياً إلى إعطاء الطلب أولوية.

يجب دعم طلب الأولوية بأدلة واضحة وحديثة تبين أن الظروف استثنائية، وأن هناك حاجة حقيقية لاتخاذ قرار مبكر.



أهم النقاط

  • بدأ العمل بالتوجيه رقم 117 في 25 يوليو/تموز 2026، وحلّ محل التوجيه رقم 102.
  • تحصل بعض طلبات تأشيرات العائلة التي قدمها مقدم الطلب الرئيسي أثناء وجوده داخل أستراليا على أعلى أولوية عامة.
  • تُعطى أولوية أقل للطلبات المقدمة من خارج أستراليا أو التي تشترط وجود مقدم الطلب خارج أستراليا وقت منح التأشيرة.

  • لا يضمن التوجيه مدة معالجة محددة أو نتيجة إيجابية للطلب.
  • ستستمر معالجة طلبات تأشيرات العائلة الخارجية، لكن قد يواجه بعض المتقدمين فترات انتظار أطول.
  • يمكن إعطاء بعض الطلبات أولوية في ظروف إنسانية واستثنائية محدودة.
  • يجب على المتقدمين الاستمرار في تحديث دائرة الهجرة بأي تغييرات مهمة وتقديم المستندات المطلوبة ضمن المدة المحددة.
  • ينبغي الحصول على استشارة قانونية قبل سحب الطلب أو تغييره أو تقديم طلب تأشيرة آخر.
